October 11th, 2008Problem with getting paycheck too early?
I work for a small group of Dr’s. and have been for about 5 months. Our office manager has been giving us our paychecks on Thurdays but I found out about 1 month ago that our paydays are really Fridays. I have thought the whole time that our paychecks were in the bank on thursdays. I had about 7 bills that were automatically coming out of my bank on Thursdays which I Bounced all of those checks and over drew my account. After confronting the office manager about it she just said “oh sorry” I found out that that was illegal for her to give paychecks out early, So my question is what should I do? Have the office pay for all of the bounced check charges or what? in the last 3 months it has cost me about $1200 in bank charges.
I was never told payday was on Friday. My checks had been going into my account on thursdays up until a month ago. It is illegal to give checks out early.

Fit4Life - your paycheck has an effective DATE on it, so even if you were given your paycheck early it could not be cashed until the effective date.
Sorry, but even though you didn’t know your payday was on Friday not Thursday, your office manager is not to blame for your bounced checks.

I think you are saying that you have an automatic deposit of your paycheck with your company, as well as automatic withdrawals. The office manager is giving you your paystub, and not actually your pay check. Even if she has given you your check on a Thursday, and you deposited it on Thursdays, on your way home from work, your check would not have been credited to your account until Friday. You did not have the money available in the bank until Friday. If you had withdrawals on Thursday, then your account would have been overdrawn. It is not your company’s job to insure that you have sufficient funds to pay your bills. It is yours. You should have been aware of this the first time in happened, and not let it go so long.

It took you 3 months to figure out what was going on? Also, if you have automatic deposit, your stub (which is NOT a check) should say clearly when the deposit is made.
