December 28th, 2008How to appeal Court Ordered Wage Garnish here in Australia?
I recently had a company take me to court for a large amount of money I owed them for a loan, from about 5 or more years ago. The police served me with the notice from the court with a 21 day period in which I could appeal.
It went through and I didn’t appeal it, since I figured the only way I would pay this big debt would be to have it garnished, kind of doing me a favour in an odd way. What I wasn’t aware of was that the garnish would be 20% of my net wages every week. That’s a fair bit of money. My Child Support Payments to my ex partner have recently been assesed (think everyone’s here have since tax time?) & now it’s gone from bugger all to a lot per month as i wasn’t working for most of the financial year prior to this one. This new assessment has only been done and me notified, AFTER the first few garnishes of my wages.
Circumstances have changed, so can I appeal to have the garnish decreased at all, now it’s outside of the appeal time? Or is it just too bad?
